The former Newcastle United player is taking a case against the club as a result of the way he was treated during his battle with cancer.
The star was diagnosed with testicular cancer and is taking a case for disability discrimination against his former employer, which will be heard by a tribunal next March.
He was released by Newcastle at the end of the season and now plays for Deprotivo La Coruña in Spain, and spoke to the BBC during his battle to say that he felt as though the club didn't care about him.
The Argentine footballer became a huge fan favourite as a result of his battle, and returned to action last May to score a goal that helped to keep the club in the Premier League.

With a bad mood already surrounding the north-east club and a more or less constant campaign to get the owner Mike Ashley out, there's unlikely to be any fans who will have ill feeling towards Gutierrez for his decision to take a case.
